SERVICE #1

Placing information about your property
on TWO real estate brokers' Multi-Listing Services (MLS) - Realcomp MLS and MiRealSource MLS -
and THREE websites: Realtor.com, Google.com, HomeSeekers.com
 

No matter what you may have heard from your friends, relatives and colleagues, Brokers' Multi-Listing Service (MLS) remains, and will do so for the foreseeable future, a single most powerful marketing tool when it comes to selling your property. Our service allows you to instantaneously obtain a huge advantage over other "For sale by owners" since your property will receive broad exposure literally to thousands of real estate agents, hundreds of whom at any given time work with buyers, not just few curious people who happened to drive by your home and call off your sign. 
  
What is the biggest problem nearly all "For sale by owner"s face? Exactly: few people know that their property is for sale. Most of them (more than 90%, according to our calculation) would even agree to pay a commission to a broker who brings a buyer but, again, who knows it? Remember: agents are not obliged to show your home to their clients with whom they have agency relationship or customers with whom they do not have such relationship. Why not? Because if not listed on the MLS, your home is nonexistent for agents. They don't know whether they will be compensated if they bring you a buyer and, therefore, they don't do anything unethical when they direct their clients' or customers' attention to properties listed with real estate brokers. 
  
Do some people sell their homes "by owner"? Absolutely. Different sources show different data but generally between 12%-17% homeowners manage to do so. But here is another piece of statistics you may not be aware of: according to the National Association of Realtors, about 80% of home buyers purchased their homes using services of real estate agents. And agents use the MLS as it provides them with the latest up-to-date information about the market, available properties in different areas, their market history, public records, etc.
 
When information about your home is placed on the MLS, not only agents will know right away it is available for sale, lease or both, they will know that you offer compensation if they bring you a buyer. And many, if not most, agents do their best to pre-qualify potential buyers, i.e. to make sure the latter will be able to afford to buy what they want to buy: for agents, it is not worth spending time with people who are not intending or able to buy anything. As for the amount of compensation to buyer's agent, it will be entirely up to you to decide what you wish to offer for there is no law determining specific amount of such compensation.

  • No Exclusive Contract is required;
  • You are always free to sell your property yourself and not pay any real estate commission at all;  
  • You are free to list your property with any real estate broker of your choice at any time;  
  • You are free to keep your own sign with your phone number in front of your property, your phone number will be displayed on the MLS so agents with potential buyers will contact you directly;  
  • You may keep information about your property on the MLS as long as you like if you select that option; 
  • 1 main and up to 5 additional photos may be uploaded onto the Realcomp MLS (primary MLS for agents in Oakland and Wayne Counties, has information sharing agreements with 7 local Boards of Realtors©); 1 main and up to 8 additional photos may be uploaded onto the MiRealSource MLS (primary MLS for agents in Macomb county);
  • You can withdraw your property from the MLS at any time for any reason;  
  • You are responsible for providing us with information about and photo(s) of your property to be entered into the MLS; when listed, the source of information will be checked as "Seller";  
  • All communication regarding your property between HAVEN Realtors and you shall be conducted in writing by email, mail or fax. No verbal communication shall be conducted;  
  • Information about your property will be entered into the MLS within 2 business days from signing the Agreement of Service by HAVEN Realtors; proof of that will be emailed, mailed or faxed to you in the form of an MLS listing ticket; in most cases, though, it takes only a few hours to place your property on the MLS;  
  • In relation to Home sellers, HAVEN Realtors acts exclusively as Transaction Coordinator when providing this Service;  
  • For this Service, HAVEN Realtors will not charge you a commission. Instead, you will pay a one-time flat fee. This fee is due upon signing Agreement of Service and is non-refundable except in the 4 cases outlined below;  
  • HAVEN Realtors does not represent real estate Buyers. 

       

Your fee will be fully refundable:
  • If, upon receiving a written offer on your property, you hire HAVEN Realtors as your agent to negotiate and coordinate the transaction on your behalf; the fee for such service will be 1 (one) percent of the finally agreed to sales price of the property payable at closing; the fee will be refunded to you at closing;  
  • If you decide to switch to a Full Service listing with a broker and agent suggested by HAVEN Realtors, the fee will be refunded to you at closing;  
  • If you purchase any real property at any time in the future using services of a broker and agent suggested by HAVEN Realtors, the fee will be refunded to you at closing;  
  • If HAVEN Realtors does not perform according to the Agreement of Service.  

SERVICE #2

Full representation of a Client as Seller's Agent
in negotiation with Buyer and/or Buyer's agent(s)

 
With this Service, we establish a full-fledged Seller's Agency with all Fiduciary Duties to Seller advocating and promoting only Seller's best interests. Your status changes from Customer to Client. HAVEN Realtors will NOT represent Buyer or act as Dual Agent unless instructed to do so by you. If Buyer is unrepresented but desires real estate representation, we will refer such Buyer to another real estate broker. 
 
Many home sellers often do not realize that being represented significantly benefits and actually may save them money. How? First of all, everybody needs to realize that a real estate transaction is adversarial in its nature for the parties involved pursue totally different interests. Sellers want to sell as high as possible and buyers want to buy as low as possible. Practicing real estate agents negotiate real estate transactions almost every day. They know tactics and strategies; they possess knowledge, experience and expertise to provide best representation and advocacy for their clients' interests.

Agents do not have that emotional attachment to a property many Sellers do which allows them to fully concentrate on the subject. It is similar to the sphere of law: ever wondered why even experienced top-notch attorneys are represented by an outside counsel rather than represent themselves when they are a party in litigation?
  
When HAVEN Realtors represents you as Seller in negotiations with Buyer or Buyer's agent, we, first of all, will make sure that you receive a comprehensive written offer (also known as Purchase Agreement, Buy-Sell Agreement, Agreement of Sale, etc.) on your property (by the Michigan Statute of Frauds, a verbal offer and its acceptance do not create a binding real estate contract) accompanied by Buyer's pre-approval (not pre-qualification) letter (if purchase is to be financed) or proof of funds (if Buyer is to pay cash). We will contact the institution that issued such letter to verify.
We will always recommend that you ask Buyer to enclose Earnest Money as evidence that he/she is serious in his/her intentions to go ahead with the transaction and is willing to potentially risk this money were he/she to breach the contract.

Before the contract on your property is fully executed, we will go with you through every single provision of it, explaining to you what that or another term or detail of the contract means for you now or may mean in the future.
 
We will make sure that you have all needed forms to be reviewed and
signed by Buyer prior or during the transaction.
 
We will discuss with you all components of negotiation process, options and strategies.
 
We will provide you with the names of several Title companies if you do not know one. We will communicate and coordinate the entire transaction with the Title company making sure everything is done timely.  
 
 
In addition, HAVEN Realtors pledges:
  • to spend as much time and effort on your transaction as needed;  
  • to provide Seller with all our knowledge and expertise on all related real estate matters pertaining to the transaction; to help craft best possible negotiation strategy and tactics in order to obtain the best possible price and terms of the sale contract for Seller; 
  • to never disclose any confidential or sensitive information about Seller, Seller's motives, Seller's situation etc. before Buyer or Buyer's agent unless instructed to do so by Seller in writing; 
  • to provide Seller with the names of several real estate attorneys if Seller does not have one yet but would like to consult one; 
  • to explain all steps and details of a real estate transaction, help review closing papers and accompany Seller to the closing.

     

Facts about this Service:
  • Full Seller's Agency relationship is established ONLY by a written contract between HAVEN Realtors and Seller; 
  • Fee for this Service is ONE percent of the finally agreed to sales price of the Seller's real property. The fee is due at closing; 
  • We negotiate on your behalf according to your instructions. However, nothing prevents you from directly contacting Buyer and/or Buyer's agent at any time although we advice our clients not to do that unless really necessary; 
  • We will obey all lawful instructions from you as Client. 
      
SERVICE #3
Consulting on residential real estate matters for
present and potential Buyers and Sellers

This Service is provided in the form of a verbal consultation session / meeting when we will be happy to devote up to 2 hours solely to your real estate related questions and issues. We will cover topics of your specific interest, answer your questions in detail and provide you with lots of additional useful information.

  

Facts about this Service:
  • HAVEN Realtors practices residential real estate only and is licensed in Michigan only;  
  • It is a one-time service and maximum duration of consultation session/meeting is two hours;  
  • We encourage you to contact us by email, mail or fax and to outline questions/issues of your interest prior to our meeting so we will be able to properly research them, if needed, and to provide you with the fullest answers possible;  
  • Providing this Service, we do not establish any type of real estate agency with our Customers. Please do not ask us for a specific advice in a specific situation you are, were or may be involved unless you hire HAVEN Realtors to fully represent you as your agent (written contract is required);  
  • If you decide to hire us as your agent, the consultation fee(s) you have already paid will be reimbursed to you at closing;  
  • If we do not have immediate answer to your question (nobody knows everything, right?), we will research it and get back to you later with the answer or opinion - of course, at no extra charge;  
  • Agreement of Service must be signed by Customer(s) prior to the beginning of the consultation meeting;  
  • Payment is due at the end of the consultation meeting;  
  • Be advised that the fee will be due in its entirety even if you have only one question that requires a "yes" or "no" type answer. Therefore, if that is really the case, you might want to save your money by doing a simple research online or at a library. 

Your $199 fee will be fully refundable:
 
  • If, upon receiving a written offer on your property, you hire HAVEN Realtors as your agent to negotiate and coordinate the transaction on your behalf; the fee for such service will be ONE percent of the finally agreed to sales price of the property payable at closing; the $199 fee will be refunded to you at closing;  
  • If you list your property with a full service broker and an agent suggested by HAVEN Realtors; you will receive full refund at closing;  
  • If you purchase any real property at any time in the future using services of a broker and agent suggested by HAVEN Realtors, you will receive full refund at closing;

Although HAVEN Realtors does not practice Buyer's Agency, we are always happy to refer you to a full service broker who will provide you with the most comprehensive Buyer's services.
